In Arizona there are different types of homicide offenses, starting with the most serious per A.R.S. § 13-1105, First Degree Murder occurs when a person who is intending or knowing that his conduct will cause the death of another person, actually does cause the death of another person with premeditation.

Second degree murder falls under A.R.S. § 13-1104, and can occur in three ways without premiditation, and Negligent Homicide A.R.S. § 13-1102 occurs when a person commits an act of criminal negligence which causes the death of another person.

Homicide Offenses in Arizona

According to Arizona law, not all murder charges are the same and therefore the penalties for homicide cases depend on the circumstances of each case. Four types of homicide cases exist:

  1. First degree: When a death has occurred and the defendant premeditated before committing the killing. This can carry a sentence of life with the possibility of parole after 25 years, natural life with no possibility of parole, or the death penalty.
  2. Second degree: When a killing is done intentionally but there was no premeditation. This can carry a sentence between 10 and 25 years in prison.
  3. Manslaughter: When the defendant recklessly killed the victim. This can result in a prison sentence of 7 to 25 years in prison.
  4. Negligent homicide: When the defendant engages in grossly negligent or careless conduct and someone dies as a result. A conviction can carry a prison sentence of up to 10 years, but a person convicted of negligent homicide may be placed on probation instead of being sentenced to prison.
